1. About Fenchoui

Fenchoui is a mobile application that allows you to visualize home renovation projects by generating design previews from photos of your rooms.

The app is published by Nicolas Torion (sole proprietorship), located at 2 chemin de bel air, 03000 Coulandon, France.

2. Acceptance of Terms

By creating an account or using the Fenchoui app, you agree to these terms of service. If you do not agree, please do not use the app.

3. Account

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account and email access.
• You may only create one account per person.
• You can delete your account at any time from the app settings. All your data will be permanently deleted.

4. Free and Paid Features

4.1 Free Features

The following features are free and unlimited:

• Creating rooms
• Importing photos
• 360° panoramic room scans
• Browsing and managing textures

You also receive 1 free design generation to try the feature.

4.2 Paid Features — Generation Credits

Design generations require credits, which can be purchased in packs via the app.

• All purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms.
• Credits are non-refundable and do not expire.
• A credit is consumed only when a design is successfully generated and delivered. If a generation fails due to a server error and no result is produced, the credit is not consumed.
• The quality of generated designs may vary depending on photo quality, lighting, and room complexity. Credits are consumed regardless of the aesthetic quality of the result, as long as a design is delivered.

5. Intellectual Property

5.1 Your Content

You retain full ownership of your photos and generated designs. You are free to use, share, download, and use them for any purpose, including commercial use.

Fenchoui does not claim any rights over your photos or generated designs. We do not use your content for marketing, training, or any other purpose.

5.2 Fenchoui's Intellectual Property

The Fenchoui app, brand, logo, textures library, and website design are the property of Nicolas Torion. You may not copy, modify, or redistribute them without prior written consent.

6. Acceptable Use

When using Fenchoui, you agree to:

• Upload only photos of interior rooms or materials relevant to home renovation
• Not upload inappropriate, illegal, or offensive content
• Not attempt to circumvent the credit system or exploit the service
• Not use the app for any illegal purpose
• Not interfere with the app's functioning or attempt to access other users' data

We reserve the right to suspend or delete any account that violates these terms or uses the service abusively, without prior notice or refund.

7. Limitation of Liability

7.1 Design Previews

Design previews generated by Fenchoui are indicative only and do not guarantee the actual result of a renovation. Colors, textures, and proportions may differ from real-world results. Fenchoui cannot be held responsible for renovation decisions made based on generated previews.

7.2 Service Availability

Fenchoui is provided "as is" without any warranty of availability, performance, or fitness for a particular purpose. We strive to keep the service available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

7.3 Liability Cap

To the maximum extent permitted by applicable law, Fenchoui's total liability to you for any claims arising from or related to the use of the service shall not exceed the total amount you have paid for generation credits in the 12 months preceding the claim.

8. Modifications

We may update these terms from time to time. We will notify you of significant changes via the app or by email. Continued use of the app after changes constitutes acceptance of the updated terms.

9. Applicable Law and Disputes

These terms are governed by French law.

In case of a dispute, we encourage you to contact us first at contact@fenchoui.app to seek an amicable resolution.

If no resolution is reached, disputes between professionals shall be submitted to the courts of Moulins (Allier), France. Consumers may bring proceedings in the court of their place of residence, in accordance with applicable consumer protection laws.
